- 1. Introduction and Scope
This Personal Data Protection Policy (“Policy”) describes how Valuex Gloserv LLP (“Valuex”, “we”, “us”) handles the personal data of our clients and their customers during the provision of advisory and para-legal services.
- Role: When we process data on your behalf to provide services, Valuex acts as a Data Processor (or “Data Fiduciary” depending on the specific engagement), and the Client acts as the Data Controller.
- Application: This policy applies to all services provided under our Service Agreements.
- 2. . Compliance with Indian Law
We process personal data in strict accordance with the Digital Personal Data Protection Act (DPDPA), 2023, and other applicable Indian regulations.
- Lawful Basis: Data is processed only for specified, lawful purposes for which the client has provided or obtained consent.
- Accuracy: We take reasonable steps to ensure that the personal data we process is accurate and complete, as provided by the client.
- 3. Use of Personal Data
Valuex will not process, modify, or disclose personal data to any third party except:
- As necessary to provide our advisory and para-legal services.
- To comply with a legal obligation or an order from an Indian court or regulatory body.
- Aggregated Data: We may use anonymized or aggregated data for research, benchmarking, and improving our internal operations.
- 4. Sub-processing
To provide efficient services, Valuex may engage third-party service providers (e.g., IT support, specialized consultants).
- Authorization: By engaging our services, you authorize us to use sub-processors necessary for service delivery.
- Standards: All sub-processors are bound by confidentiality and data protection terms no less protective than those in this Policy.
- 5. Security and Confidentiality
We implement appropriate technical and organizational measures to protect personal data against unauthorized access, loss, or destruction.
- Confidentiality: All Valuex personnel and sub-processors are bound by strict confidentiality obligations.
- Risk Management: We regularly assess processing risks to maintain a level of security appropriate to the nature of the advisory data handled.
- 6. Data Subject Rights
In accordance with the DPDPA, we assist our clients in fulfilling requests from data subjects regarding:
- Right to Access: Information about what personal data is being processed.
- Right to Correction/Erasure: Updating or deleting inaccurate or unnecessary data.
Grievance Redressal: We provide a mechanism for data subjects to register grievances.
- 7. Incident Management
In the event of a personal data breach, Valuex will notify the Client without undue delay. We will provide sufficient information to allow the Client to meet their reporting obligations to the Data Protection Board of India.
- 8. Retention and Deletion
We will delete or return personal data at the end of our service provision, unless Indian law or regulatory requirements necessitate longer retention (e.g., for audit or legal compliance purposes).
